Agreement to these terms

This website, grabovetskiy.com (the “Site”), is operated by Alexander Grabovetskiy, master wood carver (the “studio,” “we,” “us,” “our”), based in Boynton Beach, Florida, United States. By visiting or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site. These Terms (including the limitation of liability and indemnity below) are made for the benefit of the studio, its operating entity, and their respective owners, officers, employees, and agents.

About this site and its content

The Site shows our wood carving work and lets you send an enquiry about a possible commission. Everything here is for general information. Images and descriptions of past work are examples of what we have made. They are not an offer, a price quote, or a promise that we can make the same thing for you. We may add to, change, or remove content at any time, and we do not promise that the Site will always be available, complete, or error-free.

Commissions are arranged separately

Nothing on the Site is a binding offer or a contract to create work. If we go ahead with a commission, the work will be governed by a separate written agreement between you and us, covering price, schedule, delivery, and the rest. Sending an enquiry does not, by itself, create any contract or oblige either of us to proceed.

Each commission is final

Please note: a completed commission is not returnable, refundable, or exchangeable. We tell you this before any commission begins, and it is also set out in the written agreement you sign with the studio.

Every piece this studio makes is an original work, researched and carved specifically for the person who commissions it, made to the design and specifications agreed for that one commission, and to no other. For that reason a completed commission is not returnable, resellable, or refundable on a change of mind, and is not exchanged for ready-made goods. There is no second owner for a one-of-a-kind work made for you, and the studio’s research, design, materials, and work are performed and earned as the commission proceeds.

Because each commission is made to your specifications and clearly personalized, it is not subject to any general right of return, cancellation, or “cooling-off” withdrawal that can apply to ready-made goods, including the distance-selling withdrawal rights otherwise available to consumers in the European Union and the United Kingdom. We tell you this before any commission begins.

This does not lessen the studio’s commitment to deliver the work it agreed to make. Before a piece is shipped you receive photographs to approve, and any genuine departure from what was agreed will be put right. Natural variation in the wood, and the artist’s interpretation of a historical style, are part of the work’s value, not faults. Nothing on this page removes any right you may have that cannot be waived under the law that applies to you.

The full and binding terms of any commission (payment, the research and design fee, schedule, delivery, risk, and the rest) are set out in the separate written agreement you sign with the studio before work begins. If anything on this page differs from that signed agreement, the signed agreement governs your commission.

Our intellectual property

Unless we say otherwise, everything on the Site (text, photographs, images of carvings, drawings, designs, the page layout, and the name and wordmark “Alexander Grabovetskiy”) is owned by Alexander Grabovetskiy, or used with permission, and is protected by copyright, trademark, and other laws.

You may view the Site for your own personal, non-commercial reference. You may not copy, reproduce, download in bulk, scrape, republish, sell, or use any of its content for commercial purposes (or to train any artificial-intelligence or machine-learning system) without our prior written permission.

Image licensing. The photographs of carvings on this Site are not licensed for reuse, redistribution, or commercial use without written permission. To request a license to use an image, or to commission a piece, please contact the studio.

Name, voice, image, and likeness

The name, voice, image, likeness, and the distinctive hand and style of Alexander Grabovetskiy are his own. You may not use anything on the Site to create, train, or generate any artificial-intelligence model, voice clone, digital replica, or other synthetic or “deepfake” imitation of his voice, image, likeness, or identity; nor may you present any such imitation as genuine, or as made, spoken, or endorsed by him, without his prior written permission. This is in addition to any rights he has under copyright, trademark, and the right-of-publicity and similar laws that protect a person’s name, voice, and likeness.

Testimonials

Any quotations or endorsements shown on the Site reflect genuine views shared with the studio by the individuals named, and are used with their permission. They describe those individuals’ own impressions of particular work and are not a guarantee of any outcome for your commission.

Links to other websites

The Site links to other places, such as our School of Woodcarving, our social media profiles, and press articles. Those sites are run by others. We do not control them and are not responsible for their content, products, or privacy practices.

Acceptable use

Please use the Site lawfully and fairly. Do not attempt to break, overload, disrupt, or gain unauthorized access to the Site or its systems; do not scrape or harvest its content or images by automated means; and do not use the enquiry form to send spam or to infringe anyone’s rights.

No warranties

The Site and its content are provided “as is” and “as available.” While we strive for accuracy, we make no warranty that the content is complete, current, or error-free, or that the Site will be uninterrupted or secure. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Limitation of liability

To the fullest extent permitted by applicable law, Alexander Grabovetskiy and the studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the Site. Our total liability for any claim arising from your use of the Site itself will not exceed one hundred U.S. dollars (US$100.00); this limit applies only to your use of the website and does not govern any commission, which is governed solely by the separate written agreement you sign with the studio. Nothing here limits liability that cannot be limited under applicable law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to cover us for any claim, loss, or cost (including reasonable legal fees) that arises from your misuse of the Site or your breach of these Terms.

The law that applies

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.

Changes to these terms

We may update these Terms from time to time as the studio or the law changes. When we do, we will revise the “last updated” date at the top of this page. Your continued use of the Site means you accept the current Terms.
